By accessing the Site or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms.

 

1. ELIGIBILITY & ACCEPTANCE

By using this Site, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian. Use of the Site constitutes acceptance of these Terms in full.

If you do not agree to these Terms, you may not use the Site.

 

2. PRODUCTS & DESCRIPTIONS

All products offered by Sounds of Holiday are decorative items intended for display purposes only.

We make reasonable efforts to accurately describe products; however:

  • Colors, finishes, lighting effects, and design details may vary

  • Product images are representative and may not reflect exact appearance

All products are sold “AS IS” unless expressly stated otherwise.

We reserve the right to modify, discontinue, or limit product availability at any time without notice.

 

3. MODIFIED & ELECTRICAL PRODUCTS

Some products may be modified or enhanced, including conversions from battery-only operation to dual battery and plug-in operation.

All such modifications are disclosed in the product description. Customer agrees that:

  • Products must be used only as instructed

  • Improper use voids return eligibility

  • Sounds of Holiday is not responsible for damage caused by misuse or alteration after delivery

 

4. PRICING & PAYMENT

All prices are listed in U.S. Dollars (USD) unless otherwise stated.

We reserve the right to:

  • Change prices at any time

  • Correct errors in pricing or descriptions

  • Cancel orders affected by inaccuracies

Orders are not processed until payment is successfully completed.

 

5. SHIPPING & DELIVERY

Domestic Shipping

We currently ship within the United States.

International Shipping

International shipping is available to select destinations. Customers are responsible for all customs duties, import taxes, and fees imposed by their country.

Processing Time

Orders typically ship the next business day after purchase, excluding weekends and holidays.

Delivery Disclaimer

Shipping timelines are estimates only. We are not responsible for delays caused by carriers, weather, customs, or circumstances beyond our control.

Risk of loss passes to the customer upon delivery to the carrier.

 

6. ORDER CANCELLATIONS

Orders may be canceled only if the cancellation request is received before the order has shipped.

Because orders generally ship the following business day, cancellation requests must be submitted promptly. Once an order has shipped, it may not be canceled.

 

7. RETURNS & EXCHANGES

Returns and exchanges are governed by our Exchange and Return Policy, which is incorporated into these Terms by reference.

We reserve the right to refuse returns that:

  • Do not meet policy requirements

  • Show signs of use, damage, or modification

  • Are seasonal or limited-availability items

Shipping charges are non-refundable unless otherwise stated.

 

8. PREORDERS & COMING SOON ITEMS

Preorder and “Coming Soon” items may:

  • Be charged at the time of purchase

  • Ship separately from in-stock items

  • Experience delays due to supplier or production issues

Estimated ship dates are not guaranteed.

 

9. INTELLECTUAL PROPERTY

All content on this Site, including but not limited to text, images, logos, graphics, videos, and designs, is the exclusive property of Sounds of Holiday and protected by U.S. and international copyright laws.

Unauthorized use, reproduction, or distribution is strictly prohibited.

 

10. PROHIBITED USE

You agree not to:

  • Use the Site for unlawful purposes

  • Interfere with Site security or functionality

  • Submit false or misleading information

  • Attempt unauthorized access to systems or data

We reserve the right to suspend or terminate access for violations.

 

11. DISCLAIMER OF WARRANTIES

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SOUNDS OF HOLIDAY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

 

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Sounds of Holiday from any claims, damages, liabilities, or expenses arising from your use of the Site or violation of these Terms.

 

14. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

 

15. MODIFICATIONS TO TERMS

We reserve the right to update or modify these Terms at any time. Changes are effective immediately upon posting.

Continued use of the Site constitutes acceptance of updated Terms.
